Definitions

‘User’ may be defined as a person who uses and/or accesses computer software and/or material via the www.themallatcarnival.co.za Website

‘Mall@Carnival’ means Mall@Carnival

‘Processing of Information’ means the automated or manual activity of collecting, recording, organising, storing, updating, distributing and removing or deleting personal information

‘Data’ means any data (including Personal Information) provided to Mall@Carnival by the User

  • Any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
  • The biometric information of the person;
  • The personal opinions, views or preferences of the person;
  • Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
  • The views or opinions of another individual about the person; and/or
  • The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person

‘PAIA’ refers to the Promotion of Access to Information Act 2 of 2000

‘POPIA’ refers to the Protection of Personal Information Act 4 of 2013

‘Website’ refers to www.themallatcarnival.co.za

  1. Introduction

Mall@Carnival wants to help maintain your privacy and this policy has been formulated to explain the manner in which your personal information is collected and the reasons why.

In this policy, unless it appears to the contrary, the singular shall include the plural and vice versa, and any reference to any gender shall also include the opposite gender and any reference to a natural person shall include a legal person and vice versa.

This Privacy Policy complies with the objectives in terms of the POPIA and may be updated at any time by Mall@Carnival.

Kindly note that by ticking the box at the end of this Policy, you authorise Mall@Carnival to process your personal information according to this Privacy Policy.

Mall@Carnival collects your personal information in the following instances: When the User

  • Visits and/or browses the Website; and/or
  • Submits a communication or query via the Website.

  • To communicate in respect of matters the User asked to be contacted about.

Mall@Carnival shall, without obtaining User consent, disclose any information so collected where obligated to do so in terms of the law, to protect the safety of any other Website User, the public or if Mall@Carnival believes such action is necessary to protect and defend Mall@Carnival’s rights or properties.

Mall@Carnival owns and retains all rights to non-personal statistical information collected and compiled by Mall@Carnival.

  • To withdraw your consent to the processing of your information at any time. The User may do so by contacting Mall@Carnival. Mall@Carnival, however, reserves the right not to respond to manifestly unfounded or excessive requests.
